This is the official website of the MeadowBrook at Pleasant Valley Homeowners Association, Inc. (“MeadowBrook HOA”). The MeadowBrook HOA is located in Waunakee, Wisconsin, USA.
The Meadowbrook HOA acknowledges the intellectual property rights, including the independent trademark rights, of WordPress, BlueHost, Inc., Google (also known as Alphabet), PayPal, and all other plugins and connected services used with this Website. The Meadowbrook HOA claims no rights with respect to such third party intellectual property and marks.
If a person who is visiting or using the Meadowbrook HOA website (“Website”) does not wish to submit their name, email address, telephone number, address, or question/comment through the Website, the person may contact representatives of the HOA by sending an email directly to info@meadowbrookwaunakee.com. Use of this Website is not mandatory for members of the Meadowbrook HOA to access the amenities or receive any services of the HOA (except for the Website itself).
The only persons who are permitted to register for a personal, password-protected user account on the Website are persons who are members of the MeadowBrook HOA, as defined in the relevant governance documents of the HOA. Most significantly, to be a member of the HOA a person must own property in the MeadowBrook at Pleasant Valley development in Waunakee, Wisconsin, USA. Any person who attempts to register for a personal, password-protected user account on the Website who is not a member of the Meadowbrook HOA is violating the Terms of Use of the Website. The HOA Board of Directors may approve the creation of user accounts for certain non-members who have a legitimate business need to access the Website, but any such non-member accounts will be manually created by an authorized Website administrator after the account is approved by the HOA Board of Directors. That is, any such non-member accounts shall not be requested or established through the public “Registration” links/pages on the Website.
About Using the Website:
The Meadowbrook HOA website (“Website”) is built on the WordPress platform and is hosted by BlueHost, Inc. The Website also uses various 3rd-party “plugins” and other connected services of 3rd parties that facilitate the various functions and services provided through the Website. Examples of such plugins and connected 3rd-party services include PayPal, a payment processing service, and the “WP-Members” plugin, which is used to create and manage user accounts, user profiles, and user registrations/logins on the website.
Several pages of the Website also collect data from Website users through Google Forms. The pages that use Google Forms include, but are not limited to, the “Contact Us” page, the “Key Fob Inquiry” page, and the “Make a Reservation” page. Pages on this Website that use a Google Form expressly state that the form is a Google Form. Use of any Google Form is subject to this Website’s Terms of Use and also the Terms of Service and Additional Terms established by Google. Google Forms collect and send data that is entered into the form to a MeadowBrook HOA Google account and to various HOA-managed email accounts so that the inquiry provided through the form can be documented and processed.
The Website also uses and displays a Google Calendar as the HOA’s calendar of events, meetings, NCP reservations, and other activities. For example, when a User reserves the NCP, the name of the person holding the reservation and the date of time of the reservation will be displayed on the calendar. Many people can view the calendar.
The Website accepts certain payments using PayPal. The Website transmits data about the transaction to PayPal. and transfers Users to the PayPal site/service to collect payment information. Using the Website to make such payments is not mandatory, but use of the Website to make such payments constitutes acceptance of PayPal’s Terms of Use and Privacy policies.
When a user of the Website {“User”) registers for and creates an account for the Website, he or she is creating a WordPress account for the Website. The account permits the User to access login-protected content on the Website. A User who has a personal, password-protected account that can be used to login to the Website is a “Registered User.”
The Meadowbrook HOA strongly recommends that each Registered User of the Website should establish a username and password that is unique to the Website (i.e., not used for other accounts or websites), so that in the event any User information from the Website is ever compromised, other accounts held by the User will be less likely to be affected or potentially compromised. A User who fails to follow this recommendation accepts all risk associated with that decision.
The Meadowbrook HOA, WordPress, BlueHost, Inc., Google, PayPal, and various 3rd-party providers of the plugins that are used to manage the website’s functions and services may all have access to the User’s account information, profile information, and information that the User submits through the Website. To the best of our knowledge, neither Google nor PayPal has access to the Registered Users password, and only PayPal has access to the credit card information used to make a payment through the PayPal service.
A Registered User may request that this his/her account be deleted from the site administration panel by sending an email to info@meadowbrookwaunakee.com or by contacting the HOA Board of Directors in writing.
The Meadowbrook HOA and its authorized representatives may delete a Registered User’s account once the account holder is no longer an HOA member. The Meadowbrook HOA and its authorized representatives reserve the right to delete or deactivate a Registered User’s account without notice, at any time, and for any reason, including but not limited to a determination that the account holder is not eligible to hold the account, misuse of the Website, violations of the Website’s Terms of Service, or failure to pay HOA assessments. An account holder may appeal a deactivation/deletion decision to the HOA Board of Directors.
The General Data Protection Regulation (GDPR) is a regulation that requires businesses to protect the personal data and privacy of residents/citizens of the European Union. The Website is not intended to be used to conduct any business outside of the State of Wisconsin. The intent of the Website owner is that all submissions of personally-identifiable information to the Website shall originate from within the United States. Anyone residing or located outside of the United States who wishes to contact the Meadowbrook HOA may send an email directly to info@meadowbrookwaunakee.com.
VERY IMPORTANT TERMS COMING UP! User Restrictions, Assumption of Risk, Waivers of Claims, and Agreement to Hold Harmless
No person may use the Website for any unlawful purpose. No person may attempt to damage or disable the Website. No User or Registered User may attempt to gain unauthorized access to the Website, to the administration functions of the Website, or to data of the Meaodowbrook HOA or any other User or Registered User.
No Registered User shall share or disclose his/her Username or Password with any other person, except for an authorized Website administrator and except for a person who resides in the same household as the Registered User and who is also eligible to hold an account as a Registered User.
No child is eligible to be a Registered User. The Website owner (Meadowbrook HOA) does not intend for the Website to be used to collect the personal information of any child.
EACH USER AND REGISTERED USER, BY USING THE WEBSITE FOR ANY PURPOSE, AGREES THAT THE MEADOWBROOK HOA IS NOT A SOPHISTICATED COMMERCIAL PARTY AND THAT THE MEADOWBROOK HOA, AND ITS MEMBERS, OFFICERS, AND AGENTS, HAVE VERY LIMITED KNOWLEDGE ABOUT AND EXPERIENCE WITH THE TECHNOLOGY THAT ULTIMATELY OPERATES THE WEBSITE AND ITS SERVICES AND FEATURES. THE WEBSITE AND ALL CONNECTED SERVICES ARE USED EXCLUSIVELY AT THE USER’S OWN RISK. All Users and Registered Users agree that, in lieu of using the Website and in lieu of submitting any data through the forms on the Website or through the connected services (such as Google Forms or PayPal), any User or Registered User may instead contact the HOA directly via email or via U.S. Mail.
ASSUMPTION AND ACCEPTANCE OF RISKS BY USERS AND REGISTERED USERS. Any User or Registered User of this Website, by using the Website for any purpose, accepts any and all risks associated with using such an electronic, internet-based system, including but not limited to the loss of data, the misappropriation of data (including but not limited to the User’s or Registered User’s personal information), the transmission of malicious files, programs, code, viruses, or other data to the User’s or Registered User’s device(s) or accounts. Such risks include the risk of financial loss, identity theft, and damage to property (e.g., the User’s own files, devices, etc.). The User or Registered User agrees to accept such risks even knowing that the Meadowbrook HOA is not a sophisticated commercial party, as described above.
WAIVER OF CLAIMS AND AGREEMENT TO HOLD THE WEBSITE OWNER/OPERATOR HARMLESS. Any User or Registered User of this Website, by using the Website for any purpose, agrees to (1) waive any and all claims for costs or damages of any kind that result, directly or indirectly, from the use of the Website, with respect to Meadowbrook HOA and all of its members, officers, and agents; and (2) hold the Meadowbrook HOA and all of its members, officers, and agents harmless from any claims that arise from the User’s or Registered User’s own actions. The only claims that are not waived by this provision are claims against individuals (to be brought against them in their individual capacity) who intentionally and with malice cause harm or damage to the User or Registered user. All claims based on negligence are waived.
CHOICE OF LAW AND VENUE. These Terms of Use for the Website and any and all claims related to the Website that are brought against the Meadowbrook HOA, its officers, members, or agents as parties shall be governed by Wisconsin law. Except as otherwise required by law, venue for any actions brought under the Terms of Use or that are related to the Website and that involve the Meadowbrook HOA, its officers, members, or agents as parties, shall be in Dane County, Wisconsin, USA. Claims against other parties may be governed by different law and may need to be brought in other venues.
Privacy Policy
The Website uses cookies, collects usage data, and collects the IP address(es) of devices that are being used to access the Website, register as a User, and send data through forms on website. The data-entry forms and the account registration and account management pages on the Website also collect personal information from Users and Registered Users when a User or Registered User enters and submits such data.
The Meadowbrook HOA will use personal information collected from Users and Registered Users to (1) contact and respond to inquiries of Users and Registered Users, (2) manage the Website, and (3) conduct HOA business. The Meadowbrook HOA will not sell personal information that the Meadowbrook HOA collects or receives through the Website from any User or Registered User to any 3rd parties for any purpose, including for marking or solicitation purposes.
A Registered User may request that this his/her account be deleted from the Website by sending an email to info@meadowbrookwaunakee.com or by contacting the HOA Board of Directors in writing. The HOA will process all such requests and data will be removed to the extent provided by the Website’s administrator account functions, but the Meadowbrook HOA cannot guarantee that all data of the Registered User will be removed from all systems and connected services that are used to operate the Website.
Because the Website uses a variety of 3rd party service providers to manage, host, and operate the Website, use of the Website as a User or as a Registered User constitutes consent to the Terms of Service and related Privacy Policies of those 3rd parties. Such 3rd parties include WordPress, BlueHost, Inc., PayPal, and Google (aka “Alphabet”). The Meadowbrook HOA, WordPress, BlueHost, Inc., Google, and various 3rd-party providers of the plugins and connected services that are used to manage the website’s functions and services may all have access to the User’s account information, profile information, and information that the User submits through the Website. Aside from being able to delete a Registered User’s account from the Website, the Meadowbrook HOA does not control the extent to which data previously submitted through the Website, including account information from deleted accounts, may still exist and still be available to others.
